Generally a total loss is determined when the amount of repairs exceeds the value of the vehicle after salvage value is deducted. The value of your vehicle can be determined in a number of ways: dealer quotes, blue book, newspaper ads, etc. You can elect to make repairs yourself. If you can't negotiate your liability claim to your satisfaction you may want to consider checking the amount allowed in your local small claims court. It isn't insurance reform that's needed so much as making known to the public, insurance claim rights and adjusting information.
