If the worker has a full year of employment with a company having more than
20 employees, at the time of job change he will have rights under HIPAA to
continue coverage without a preexisting exclusion. Georgetwon University
has a good site on HIPAA at http://www.georgetown.edu/research/ihcrp/hipaa/
When someone does change employment it may be the new policy will require
being actively at work for a certain number of days, which has nothing to do with
preexisting. Under those circumstances, COBRA can be exercised, and
then dropped when the worker requalifies.
