The policyholder sued the automobile insurance company for fraudulent concealment
because of less benefits in new coverage that replaced old coverage. The court found that
the insurance company had explained the new coverage in a pamphlet given to the
policyholder and the policyholder had the burden of knowing the contents of the
insurance policy. The court also found that there is no fiduciary relationship between the
insurance company and the policyholder in regard to representing new coverages
available under the automobile policy:
